1. Acceptance of Terms

Welcome to Point Wars. These Terms of Use ("Terms") constitute a legally binding agreement between you and Aztec Software, LLC ("we," "our," or "us") governing your use of the Point Wars application and related services (collectively, the "Service").

By accessing or using Point Wars, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Point Wars is a score tracking application that allows users to:

  • Track games and matches between friends
  • Record scores for various sports and competitions
  • View statistics and head-to-head records
  • Connect with friends and track friendly rivalries

3. Account Registration

To use Point Wars, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use Point Wars.

4. Acceptable Use

You agree to use Point Wars only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any part of the Service or other accounts
  • Use the Service to harass, abuse, or harm other users
  • Upload or transmit viruses, malware, or other malicious code
  • Use automated means (bots, scrapers, etc.) to access the Service without our permission
  • Use the Service for any commercial purpose without our consent

5. User Content

You retain ownership of any content you submit to Point Wars, including profile information, game data, and scores ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your User Content solely for the purpose of operating and providing the Service.

You are solely responsible for your User Content and represent that:

  • You own or have the necessary rights to submit the content
  • Your content does not violate the rights of any third party
  • Your content is accurate and not misleading

6. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Aztec Software, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

8. Third-Party Services

Point Wars may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZTEC SOFTWARE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code that may be transmitted through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aztec Software, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time by contacting us. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aztec Software, LLC regarding the Service and supersede all prior agreements and understandings.
